Terms of Service

Loansure, Inc. (“Loansure”), a Maryland-based SaaS (Software as a Service) company, provides a Lead-to-Sale Platform designed for consumer direct mortgage lenders on a subscription basis (“Subscription”), including, but not limited to, independent mortgage banks, direct-to-consumer lenders, correspondent lenders, and mortgage sales teams operating in the residential lending industry.

By accessing and using any Loansure products or services (collectively, the “Services”), you (the “Client”) agree to be bound by the following Terms of Service (“Terms”), and any policies, legal notices, or program guidelines presented to you from time to time. Loansure reserves the right to update or modify these Terms at any time, which will be posted on our website at www.loansure.ai

Use of Services

‍

Loansure offers Subscription-based Services to eligible business clients. Use of the Services is limited to individuals authorized to act on behalf of an organization licensed to conduct residential mortgage lending in compliance with applicable state and federal laws.

‍

To access Loansure’s platform, you may be required to submit accurate, current registration and contact information. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify Loansure immediately of any unauthorized use or security breach involving your account.

‍

Loansure shall not be liable for any loss or damage resulting from your failure to maintain accurate account information or protect your account credentials.

‍

Ancillary Services

‍

Loansure may, from time to time, offer optional ancillary services including, but not limited to:

‍

• Custom marketing creative
• Advertising strategy
• Performance optimization consulting
• Content development
• Data enrichment and reporting

‍

These services, if purchased, will be invoiced separately at then-current rates. You, the Client, agree to pay for any ancillary services ordered. You also confirm that you have the right to use any data or content you provide for use in co-branded marketing or performance campaigns.

Customer Support

‍

Loansure provides standard customer support via phone, email, chat, and support portal during normal business hours listed on our website. Technical support related to software bugs or service outages is offered at no additional charge. Custom training, onboarding, configuration, or additional consulting services may incur charges based on current pricing.

Appropriate Conduct

‍

You agree to use the Loansure platform in compliance with all applicable laws, industry standards, and the ethical guidelines governing mortgage marketing, telemarketing, and consumer data usage.

You are solely responsible for the accuracy and legality of any content, lead data, sales material, or marketing creative you upload or generate within the Loansure system.

You agree not to:

‍

• Engage in misleading or non-compliant advertising
• Use the platform to violate TCPA, RESPA, CAN-SPAM, or other regulatory statutes
• Disrupt or attempt to compromise the security or functionality of the platform
• Use Loansure’s systems to unlawfully store or transmit consumer information

‍

Loansure reserves the right to suspend or terminate access to the Services in the event of any suspected misuse or violation of these Terms.

‍

Compliance & Regulatory Responsibility

‍

You acknowledge that it is your sole responsibility to ensure compliance with all applicable laws and regulations, including but not limited to the Real Estate Settlement Procedures Act (RESPA), Truth in Lending Act (TILA), Fair Credit Reporting Act (FCRA), and state licensing regulations.

Loansure does not warrant that your use of the Services will be compliant with these laws. You represent that you have obtained all necessary consents to share customer or prospect information with Loansure, including personally identifiable information (PII).

Loansure is not a consumer reporting agency under the FCRA and does not evaluate creditworthiness or consumer eligibility for lending purposes.

Privacy & Data

‍

By using Loansure Services, you agree to the terms of the Loansure Privacy Policy, which governs our data practices.

You authorize Loansure to access, store, and process your account data and any content transmitted through the platform for the purpose of delivering Services, monitoring usage, ensuring compliance, and improving performance.

‍

You agree not to upload or transmit the following data types into the platform:

‍

• Protected Health Information (PHI)
• Payment card data (PCI)
• Social Security Numbers (SSN) without encryption or prior approval
• Information about children under 13 years of age
• Any data subject to specialized privacy regulation without prior coordination

‍

Intellectual Property

‍

All content, software, methodologies, visual interfaces, proprietary data sets, and features within the Loansure platform are the exclusive property of Loansure, Inc. and protected by applicable intellectual property laws.

‍

You may not:

‍

• Reverse engineer, copy, or modify the platform
• Use any part of the Service outside the scope of your subscription
• Sell, sublicense, or share access to any Loansure software or data
• Remove or obscure copyright, trademark, or proprietary notices

‍

You retain ownership of any custom content or data you upload to the platform but grant Loansure a non-exclusive, royalty-free license to use such content solely in connection with delivering the Services.

Subscription Terms & Billing

‍

Fees for Subscription Services are defined in your executed Order Form or Subscription Agreement. Subscriptions are billed monthly or annually in advance and are non-refundable.

You authorize Loansure to process recurring charges to your designated payment method. Failed payments may result in service suspension. Loansure may revise pricing or add surcharges upon written notice in accordance with market conditions or usage changes.

Non-use of the platform does not constitute cancellation. Termination must be requested in writing and confirmed by Loansure.

Platform Limitations

‍

Each Subscription is limited to the number of users and domains as outlined in your Order Form. Unauthorized access or overuse may result in additional charges or termination.

‍

You agree not to:

‍

• Use web scrapers, bots, or automated scripts to extract platform content
• Circumvent usage limits or attempt concurrent logins beyond your user license
• Frame or embed the platform outside of approved integrations

‍

Modifications and Availability

‍

Loansure may improve, modify, or discontinue features at its sole discretion. While we strive for 99.9% uptime, Loansure does not guarantee uninterrupted access and is not liable for service outages due to maintenance, updates, or third-party providers.

We reserve the right to apply automatic updates or security patches as necessary to maintain the integrity of the platform.

Termination

‍

Loansure may suspend or terminate your account for:

‍

• Non-payment
• Material breach of these Terms
• Illegal or unethical use of the platform

‍

Upon termination, your access will cease and you may request return of eligible data, subject to Loansure’s data retention policy.

‍

Limitation of Liability

‍

To the maximum extent allowed by law, Loansure shall not be liable for:

‍

• Loss of revenue, profits, or data
• Business interruption or reputational harm
• Claims arising from third-party integrations or service providers

‍

Total liability for any claim shall not exceed the amount paid by Client in the previous twelve (12) months.

‍

Disclaimer of Warranties

‍

The platform is provided “as is” and “as available.” Loansure disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee any specific marketing results or loan conversion outcomes.

‍

Indemnification

‍

You agree to indemnify and hold harmless Loansure, its employees, contractors, and affiliates from any third-party claims arising from:

‍

• Your misuse of the platform
• Your non-compliance with applicable laws
• Any data or content you provide or distribute using the platform

‍

Governing Law

‍

These Terms are governed by the laws of the State of Maryland. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Baltimore County, Maryland.
